LoomiBook Terms of Service

Effective date: May 8, 2026

These Terms of Service ("Terms") govern your use of LoomiBook (the "Service"), operated by Harman Digital Consulting LLC, doing business as LoomiBook ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms.

These Terms apply primarily to Stylists — the businesses or individuals who subscribe to LoomiBook to manage their appointment booking. Clients (consumers who interact with a Stylist via the platform) are governed by §3 (Client Interaction) and our Privacy Policy.

1. The Service

LoomiBook provides a multi-tenant SaaS platform for independent hair stylists and small salons that offers:

  • Online appointment booking
  • An AI-powered SMS booking assistant
  • Client management
  • Schedule and availability management
  • Optional marketing and rebooking automation
  • Optional payment processing (via Stripe; see §5)

We may add, modify, or remove features over time. Material changes will be communicated in advance.

2. Account and eligibility

You must be at least 18 years old and authorized to operate the business associated with your LoomiBook account. By creating an account you represent that the information you provide is accurate and that you have authority to bind the represented business to these Terms.

You are responsible for:

  • Keeping your password and authentication factors secure
  • All activity under your account
  • Promptly notifying us of any unauthorized access

3. Stylist responsibilities (and Client interaction)

Because you (the Stylist) are the party who has a relationship with your Clients, you are responsible for ensuring the following:

3.1 Lawful use

You may not use LoomiBook for any unlawful purpose, including but not limited to: harassment, spam, illegal services, or services that violate carrier acceptable-use policies (gambling, controlled substances, hate content, sexually explicit content, etc.).

3.2 Client consent

Before initiating SMS contact with a Client through LoomiBook, you must have a legally sufficient basis to contact them under applicable law (including the Telephone Consumer Protection Act in the United States). LoomiBook provides tools — the YES consent attestation prompt for active outreach, and the first-booking opt-in checkbox for marketing — to help you record consent. You agree to use these tools in good faith and to honor opt-out requests immediately.

You attest that any phone number you brief the AI assistant to contact has consented to receive booking-related SMS from you.

3.3 Accurate business information

You must keep your services, pricing, hours, and other business information accurate. You are responsible for fulfilling appointments booked through the platform.

3.4 Carrier and platform compliance

You agree not to use LoomiBook in a manner that violates Twilio's Acceptable Use Policy, U.S. carrier policies (CTIA), or 10DLC requirements.

4. Subscription, fees, and payment

4.1 Subscription tiers

Current plans (subject to change with notice):

  • Starter: $9/month — basic booking, reminders, smart link
  • Pro: $19/month — AI booking assistant, SMS prep, smart rebooking, unlimited SMS
  • Business: $39/month — Pro plus payment processing, marketing campaigns, multi-staff (additional staff $10/month each)

4.2 Trial

New accounts include a 14-day free trial. No charge during the trial. You may cancel at any time during the trial without charge.

4.3 Billing

Subscriptions renew monthly. We bill in advance. You authorize us to charge your payment method on each renewal date.

4.4 Refunds

Subscription fees are non-refundable except where required by law. We may, at our sole discretion, prorate refunds in unusual circumstances (e.g., extended platform outage).

4.5 SMS overage

Plans include a base allotment of SMS messages. Additional SMS may be billed as overages or capped depending on your plan. Twilio carrier fees are passed through at cost.

4.6 Taxes

Prices are exclusive of taxes. You are responsible for any applicable sales, use, or VAT taxes on your subscription.

4.7 Late or failed payments

If your payment method fails, we will notify you and retry. Continued non-payment may result in suspension and eventual closure of your account.

5. Payment processing for your business (Stripe)

If you enable the optional payment-processing feature to charge your Clients (deposits, invoices, no-show fees), Stripe processes those payments and you must agree to Stripe's terms separately. LoomiBook is not a party to your transactions with Clients; we provide the integration only.

6. AI assistant — limitations and your acknowledgment

LoomiBook's AI booking assistant uses large language models (currently Anthropic's Claude). The AI may occasionally:

  • Misunderstand intent or context
  • Suggest unavailable times due to data sync delays
  • Use language that is slightly off-tone

You can configure the AI's autonomy level (Mode 1: drafts only; Mode 2: AI Suggests, you send; Mode 3: AI Handles autonomously) and can override or disable it at any time. You remain responsible for the outcomes of bookings made through the platform.

We use commercially reasonable efforts to keep the AI accurate but provide no warranty that the AI will be error-free.

7. Acceptable use

You may not:

  • Send unsolicited messages or spam
  • Use LoomiBook to operate a service we have not approved
  • Reverse engineer, scrape, or attempt to extract our or any other tenant's data
  • Resell or sublicense the Service without written permission
  • Impersonate another person or business

We reserve the right to suspend or terminate accounts that violate these rules.

8. Intellectual property

LoomiBook and its features, code, designs, and content are owned by us. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain ownership of all content you upload (services, descriptions, logos, photos). You grant us a limited license to display and process your content as necessary to provide the Service.

9. Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using the Service you consent to the practices described there.

10. Termination

You can cancel anytime via your account settings or by emailing support@loomibook.com. Cancellation stops further billing; you retain access through the end of the current billing period.

We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or use the Service in a way that creates legal or carrier risk. We will give notice when reasonable.

Upon termination:

  • We will retain your data for 90 days to allow account recovery, then delete or anonymize per our retention schedule
  • You may request a data export before deletion

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES.
  • OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

13. Indemnification

You agree to defend and indemnify us from claims arising out of: your violation of these Terms, your use of the Service, your interactions with Clients, or your failure to obtain proper consent before sending SMS.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in [County, State — to fill in], and you consent to the exclusive jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use of the Service after the effective date of revised Terms constitutes acceptance.
